Who can sign a Statutory Declaration?

Statutory Declarations Act, 1938

Section 1(1)

It shall be lawful for any of the following persons:

  • a notary public

  • commissioner for oaths

  • peace commissioner

  • person authorised by law to take and receive statutory declarations

to take and receive the declaration in writing of any person making the same before him in the form set out in the Schedule to this Act.

Section 6

Every person who makes a statutory declaration, which to his/her knowledge is false/misleading in any material respect shall be guilty of an offence under this section and liable on summary conviction to a fine not exceeding fifty pounds or, at the Court’s discretion, to imprisonment for a term not exceeding three months, or to both such fine and imprisonment.
